The new Town and Country Planning (Environmental Impact Assessment) Regulations 2011 came into force on 24 August 2011. The new EIA Regulations consolidate and revoke years of amendments to the 1999 version and reflect recent case law. They are applicable in England only - Scotland's own EIA Regulations came into force in June, with Wales to follow suit towards the end of the year.
Most of the changes in the new Regs. are well-known, having emerged through case law in recent years. Considering the potential need for EIA at various stages of the development process, and the necessity for a clear paper trail to ensure the robustness of the EIA process, we welcome the consolidated and updated Regs. which are clearer than ever.
